How do you collect evidence for a case and document the liability and the damages in your case?

You should always collect:

  1. Accident reports - they are the recent recollection of the officer and what he saw immediately after the incident. An officer can't testify to an accident that he or she didn't see.  If an officer testifies to an accident that he or she didn't see, he or she lacks the personal knowledge and this may be hearsay.  However, an officer can testify to the admission that a defendant made on his/her way to the ambulance.
  2. Medical Records - can be used to prove your injuries.  This includes your medical doctor and nurse reports; and, medical billing and pharmacy records.
  3. Witness Statements - can be helpful. 
  4. Photographs - can always be used but they should be time-stamped and dated.
  5. Statutes and Cases - Often the states laws and statutes are used in court to prove that a person violated their standard of care and this can be used. 
  6. Prior criminal and driving records - may be used in some states. 
  7. Witness statements - can be used.
  8. Pay check stubs - And evidence of other lost wages should be documented.
  9. Auto body shop repair - estimates should always be preserved as evidence.
