Who Can I Collect From?

Whenever you are involved in an auto accident, you have several people that you may be able to collect from.  Never assume that you can't collect for an accident.

  1. You may be able to collect from the government often there are uninsured and underinsured motorists statutes and government programs that allow you to collect from a victims fund.
  2. You may also be able to sue the government directly if it had employees that injured you or if it caused your injury through its acts or poor roads etc.
  3. You may be able to collect from your employer or
  4. You may be able to collect from the employer of the person that hit you.  If the Dominos pizza boy was delivering, you can sue not only the driver,  Dominos also.
  5. You may be able to collect from the landlord.  If you were in the parking lot, you need to ask yourself, was the lot properly designed and maintained, or was it partially at fault.
  6. You may be able to collect from the renter or his renters insurance and you may be able to sue both the landlord and the renter.
  7. You may be able to collect from your auto insurance company.
  8. You may collect and use your own health insurance
  9. If you were a passenger, you may be able to use  the drivers insurance company
  10. You may be able to use the insurance company of the person that hit your car.
  11. You may be able to collect from the Drivers parents if the driver was underage.
  12. You may be able to collect from the owner of the car that hit you if the driver was not the owner.
  13. If that person was employed you may be able to collect from his employer, that business, or their insurance company if he was on a business errand.
  14. You may be able to collect from the utility company if you had to go around persons working on utility lines is that was the reason the accident happened.
  15. You may be able to collect from the manufacturer of the product that injured you.  For instance if your car caused the accident the auto manufacturer may be at fault.
  16. You may also be able to collect from the seller of that product if what injured you was the defective product.
  17. You may also be able to collect from multiple defendants
  18. You may collect from Workers Compensation.
  19. You may be able to collect from Medicare, Medicaid, or other government programs.

You can see that who you collect from often depends on your theory of who was at fault.  Often what seemed to be a worker's compensation case is an accident case, or a landlord-tenant case, or may be a defective product case.  When one defendant has an empty pocket, often the other will be covered by insurance.
