Your 341 meeting:

Your 341 meeting is a simple hearing that is far more like a deposition where you would sit with your attorney and answer questions about your income expenses property debts and any transfers of property prior to filing.  A CPA or attorney administers an oath and you identify yourself by producing a copy of a photo id and your social security card.

Long before the hearing your attorney will send documentation to the trustee to prove the facts in your petition.  We normally supply this to them as adobe pdf documents.  This simple video was made by the bankruptcy court to show you what a 341 meeting is like.

You will notice that the hearing is very informal but you should still be prepared to answer any questions.  You should know what a redemption and a reaffirmation is so when you are asked about these and other questions you can intelligently answer the trustee what you plan to do with your property.

The Trustee is paid a very small fee to verify the facts in your petition.  If you can not reasonably answer the questions your hearing may be continued,  you may lose property, or  go through hours in a 2004 examination similar to an IRS audit with substantial additional costs and time spent.

This is why we made this educational website for our clients so that you will be prepared for the judges and the trustees and you will bankrupt the maximum amount of debt and keep the maximum amount of property.

This information is educational, not legal advice.  If you have specific Chapter 7 or 13 bankruptcy questions ask an attorney or contact us about being your lawyer.
