This is a general outline of some of the possible steps in
a Kentucky DUI Defense made by an attorney.
1. ARRAIGNMENT and or BOND REDUCTION HEARING if you contact us
early in your DUI case we will appear at your arraignment or bond
reduction hearing.
2. Interrogatories and requests
for production of documents- Shortly after you are charged with
a DUI we will file discovery requests. This is a demand to the
prosecuting attorney for evidence and
information. If the prosecuting attorney does not produce the records your
DWI case could be dismissed.
3. Negotiated Settlements - Often a settlement
on your DUI may be worked out
prior to trial with the County Attorney. Not every person can afford a full
DWI defense and you may
want to negotiate a settlement. The reputation of a quality
DWI defense lawyer is a factor and how well he can handle your case is
a factor in what you will be offered as a settlement.
4. Investigations -
If you wish to go to trial the arrest location is checked out and visited.
Officers and witnesses may be
interviewed and expert witnesses may have to be hired to prove
innocence or doubt. In the case of a felony DUI, your lawyer will
probably question the officers at the probable cause hearing. If the witness changes his story then the transcript
can be used to impeach that person. The probable cause hearing
in a felony DUI case may be your only opportunity to get this evidence before
trial.
5. MOTIONS TO DISMISS AND/OR SUPPRESS - These are motions
to prevent DWI evidence or testimony from being used commonly. We file
motions to suppress or motions to disclose evidence as well as motions for
discovery. These normally require a court appearance.
6. TRIAL - Your DUI trial may take hours or days. Generally we
believe that it is a poor idea to place the client on the stand. That
puts you on trial when you need to put the officer and prosecutor on trial.
It is a bad idea to put the police on trial for lying or moral wrongs.
However the police are human and all people make mistakes or can be
mistaken.
