Chapter 7 eliminates most unsecured debt—credit cards, medical bills, and personal loans.  It takes about 90 to 120 days and is the quickest and cheapest method to discharge your debt.

  • Do You Qualify? We search for allowed expenses to help you pass and qualify for the Means Test.  Because a Chapter 13 pays a much higher fee, some offices may not work to get you qualified for a Chapter 7.

Chapter 13 is a structured 3-5-year repayment plan to catch up secured debts and manage priority debts.

  • Stopping Foreclosure: We cure missed mortgage payments (arrearages) over the plan’s life so the default is cured at the end of the Chapter 13 plan.
  • Reducing Car Loan Debt: We can often perform a **Cram Down** on older car loans to make them affordable in a Chapter 13.
  • Stripping liens, second mortgages: If you have been sued, we can often strip judicial liens on your home in a 7 or 13.  But in a 13, we can also often strip off a second mortgage that has no equity when the house is worth as much as the first mortgage, or less.
  • Managing Non-Dischargeable Debts: We structure plans for recent taxes or student loan debts that can’t be discharged but can be managed or paid up to date over 5 years.

Step 1: Gathering Documents; a Confidential Consultation & Financial Snapshot

Your Action: To file for bankruptcy, the court requires you to gather a simple list of documents.  The Judge and Trustee require these documents to provide proof of your finances. (tax returns, prior six months of pay stubs, bank statements, car titles, deeds and mortgages, Social Security cards, and your driver’s license).  Here is the list. The Judge and Trustee cannot do their jobs without this proof. The documents should be saved in order on a thumb drive in PDF format, but you may also upload them in the intake.   

Step 2: Mandatory Counseling & Personalized Strategy Session to where we prepare your petition.

Your Action: To file a Chapter 7 or Chapter 13, you have to complete the mandatory pre-filing **Credit Counseling Course**.  We like https://bkcert.com/.  If you file without taking this course and getting the class certificate first, the case will be dismissed. There is a second class you must take after filing to get the discharge. 

Step 3: To make your filing easier, fill out our intake form (its on the right hand side).  

Your Action: To save time and trouble, fill out our contact form. We will send you a link to an intake to complete, which will arrive in your email.  You can complete the intake at home 24 hours a day to list your income, expenses, assets, and debts.   

You then make an appointment, and I personally prepare your petition with you.  On filing, the **Automatic Stay** is activated. Collections and the stress stop.

You will have a 341 Meeting about 4 to 6 weeks later: Attend a brief 341 Meeting with Nick Thompson via Zoom from our office.  The Trustee will conduct the hearing, but Nick will be right beside you.  He has done these hearings for over 3 decades.
