Follow our simple 3-step filing process to get started.

Step 1 Documents

Gather Your Documents: Trustees and Judges trust debtors to provide accurate information, but it is their responsibility to verify the petition with the necessary supporting documents required for bankruptcy filing.

Your Action: To begin the bankruptcy process, the court requires a simple set of documents. The Judge and Trustee will use these documents to verify your financial situation. Required documents include tax returns, the last six months of pay stubs, bank statements, car titles, deeds and mortgages, Social Security cards, and your driver’s license.

Here is the Checklist for Consumers. This is the checklist for a small business bankruptcy. The Judge and Trustee cannot proceed with their responsibilities without these documents to verify your petition. Please save them in the correct order on a thumb drive in PDF format.

We begin by having you sign up for an intake, which you can complete from the comfort of your home. To get started, simply complete the form at the bottom of this page.

Step 2 Credit Counseling

Each Chapter 7 or Chapter 13 case requires you to complete a 1-2 hour online Credit Counseling course before filing, followed by a second Debtor Education course after filing to receive your discharge.

Your Action: I like https://bkcert.com/, but prebk.com and other providers are cheaper. Our attorney code for pre-bankruptcy counseling is NT 0905. While you may choose any provider, it’s essential to complete the entire chat session at the end; otherwise, the certificate will not be issued. If the course is not completed and the certificate is not obtained, the court may dismiss your case. Additionally, you must complete the second “Debtor Education” course to receive your discharge.

At the beginning, we sit down with clients to plan their goals. During a second meeting, I will personally meet with you, review your intake, and prepare your petition. You will never be handed off to a paralegal for petition preparation. I attend court with you and remain by your side throughout the process. To ensure personalized attention, I limit my caseload to fewer than 20 cases per month.

Step 3 Online Intake

An Easy, More Accurate Intake

Your Action: To save time and ensure accuracy, fill out the form below. We will send you a link to complete your MyChapter intake, which you can finish at home, 24/7. The intake will ask for details about your income, expenses, assets, and debts.

Afterward, schedule an appointment. I will personally prepare your petition. Once filed, the “Automatic Stay” will be activated, halting foreclosures, garnishments, repossessions, and collections.

341 Meeting:
About 4 to 6 weeks after filing, you will attend a brief 341 Meeting via Zoom from our office. The Trustee will conduct the hearing, but I will be there with you every step of the way. With over 38 years of experience, I ensure you have the guidance you need during this process.

Experience Matters

ABI statistics show 98%-100% of do-it-yourself Chapter 13 cases are dismissed.

Law firms nationwide complete or discharge only 40% of Chapter 13 plans.

Our KY Chapter 13 discharge or completion success ratio is over 60%.

Our success ratio for Chapter 7 discharge is over 99%.

Three Federal Banking studies confirm that the wealthy often use the bankruptcy code to increase their wealth.
The bankruptcy filing process was designed for consumer bankruptcy, not just for businesses. According to the Federal Reserve Bank of New York:
Individuals who file for bankruptcy see a significant increase in their credit score, whereas those who do not file experience much slower recovery in their credit score.

Chapter 7 Bankruptcy: Fast and Permanent Debt Relief

Chapter 7 eliminates most unsecured debts, including credit cards, medical bills, and personal loans. The process typically takes between 90 and 120 days, making it the quickest and most affordable way to discharge your debt.

Do You Qualify?
We identify allowable expenses to help you pass the Means Test and qualify for Chapter 7. Some offices may not prioritize getting you qualified for Chapter 7 because Chapter 13 requires higher fees. However, over 90% of debtors are eligible for Chapter 7. You may qualify if your income is below average or if you have no disposable income.

Protecting Your Assets:
We maximize exemptions to help you keep your home and car. You have the choice to keep or surrender your car based on your needs. Federal exemptions are often larger than state exemptions, which means you can protect more of your property.

Non-Consumer Debt Benefit:
The Means Test is waived if over half of your debt is business-related or incurred during military service. Other factors may also allow you to bypass the Means Test and file for Chapter 7. If you’ve recently become disabled, your income from the past 6 months may not be considered.

Chapter 13 Bankruptcy: Protecting Your Home, Car, and Financial Stability

Chapter 13 offers an interest-free 3-5 year debt consolidation plan that helps you catch up on and manage secured and priority debts. Unsecured debt and default payments are not subject to interest for the full 5 years.

Stopping Foreclosure:
We work to cure mortgage defaults throughout the plan, ensuring that any foreclosure or default is resolved by the end of the Chapter 13 process.

Reducing Car Loan Debt:
Chapter 13 allows us to perform a Cram Down on car loans over 910 days old, making them more affordable.

Stripping Liens and Second Mortgages:
If you’ve been sued, we can often strip judicial liens from your home in both Chapter 7 and Chapter 13. In Chapter 13, we can also remove a second mortgage if there’s no equity, meaning the home’s value is equal to or less than the first mortgage.

Managing Hard Debts:
If you have older income tax debts, I bring my expertise as a former tax prosecutor with an accounting background and license #51 before the US Tax Court. Additionally, student loan payments can be paused or managed over a 5-year period in a Chapter 13.

Critical Defenses We Use to Protect Elizabethtown Families

Ending Creditor Harassment and Seizures

Recovering Garnished Funds and Bank Account Seizures: We may be able to recover funds garnished from your wages or bank accounts within the 90 days before filing.

Protecting Co-Signers:
The Co-Debtor Stay helps protect co-signers by ensuring the debt is repaid in full under Chapter 13.

Stopping Repossessions Immediately:
We act quickly to help recover your car or return garnished funds. Delaying filing could make it difficult to recover assets, especially after a foreclosure sale.

Preventing Foreclosure Sales:
If you file even one minute after the auction, you may lose your home. Don’t wait until the last moment! It takes hours or even days to gather documents, take the required class, and prepare the petition. Use our intake process to quickly and easily prepare from home.

Improving Credit:
Bankruptcy can be a stepping stone, not a setback. With proper guidance, it can help you achieve a 720 FICO score. Staying in default is worse than starting fresh and being debt-free.
