Shift work makes the means test tricky
Lyndon hosts UPS Air Group operations and the Kroger Mid-South offices. Plenty of residents work nights, rotate shifts, or live on overtime.
The Chapter 7 means test averages your gross income across the six full calendar months before you file. It does not care that peak season inflated three of those months.
File in January after a heavy holiday season and your average looks high. File in June and the same job produces a very different number.
This is not a loophole. It is how the statute reads. Timing a filing around your own pay cycle is ordinary planning, and it is worth doing deliberately.
Bring six months of pay stubs to the first meeting. All of them, including the light weeks.
Part-time hours and a second job
A second job counts. So does gig income and a spouse’s income, even when the spouse is not filing.
There is a marital adjustment for a non-filing spouse’s expenses that are not part of the household. It is commonly missed. We look for it every time.
Garnishment on a paycheck
Kentucky lets a judgment creditor take up to 25 percent of your disposable earnings. On an hourly wage, that is the difference between making rent and not.
Filing will usually stop a wage garnishment the same day. In some cases we can recover funds garnished during the 90 days before you file.

Does your employer find out
The answer to whether your employer finds out depends on the chapter. In a Chapter 7, usually not. Nothing is sent to your employer.
A Chapter 13 is different, because plan payments are often made through a payroll deduction order. Your payroll department sees it. Your supervisor has no reason to.
Federal law also bars a government employer from firing you solely because you filed bankruptcy, and it bars private employers from discriminating in the same way.
What filing stops
The automatic stay begins the day you file personal bankruptcy in Kentucky. It stops wage garnishment, collection calls and letters, repossession, and a scheduled foreclosure sale. Most lawsuits stop as well.
What you keep
Kentucky filers may choose the federal exemption list instead of the Kentucky bankruptcy exemptions. It protects $31,575 of home equity, or $63,150 for a married couple filing together. It also protects a vehicle, household goods, and retirement savings for most families.
