Our office often sues debt collectors under the FDCPA and uses defenses such as TILA and over 100 other defenses to consumers who are sued for a debt. It’s interesting to note that debts that are sold to a company that later sues a client are difficult for debt collectors. Sometimes it’s difficult because records get lost and are missing. It is our job to look for these errors. This is not something you can do by handing the project over to an assistant. It takes a trained eye to look for the mortgage closing errors in a foreclosure. In a student loan case, you look for errors like whether the school, student, expenses, or loan was qualified and proper. Of course, often it isn’t.

Again, collection law firms are not working for the student loan consumer’s best interest. For one thing, they won’t tell you how to sue the college of lender back. They also won’t explain to you how not to pay and thereby avoid the student loan debt.
