We offer strong defenses to protect your home, assets, and income. Our goal is to help improve your credit score, increase your net worth, and ensure you can provide for your family. Follow our simple 3-step filing process to get started.
Step 1
Gather Your Documents: Trustees and judges trust debtors to provide accurate information, but their role is to verify the petition using the necessary supporting documents required for filing bankruptcy.
Your Action: To file for bankruptcy, the court requires you to collect a set of basic documents. The judge and trustee need these documents to verify your financial situation, including tax returns, the last six months of pay stubs, bank statements, car titles, deeds and mortgages, Social Security cards, and your driver’s license.
Here is the Checklist for Consumers. This is the checklist for a small business bankruptcy. The Judge and Trustee cannot proceed with your case without these essential documents to verify your petition. These documents should be organized and saved on a thumb drive in PDF format. To get started, you’ll need to sign up for an intake, which you can complete at home. Simply fill out the form at the bottom of this page to begin.
Step 2
For every Chapter 7 or Chapter 13 case, you are required to complete a 1-2 hour online Credit Counseling course before filing, followed by a second Debtor Education course after filing in order to receive your discharge.
Your Action: I like https://bkcert.com/, but prebk.com and other providers are cheaper. Our pre-bankruptcy attorney code is NT 0905. This specific code is required to complete the process successfully, so it’s important that you use it. It’s essential to finish the entire chat session by the end of the course, as failure to do so will prevent the certificate from being issued. If you don’t obtain the certificate, the court may dismiss your case. Furthermore, in order to finalize your bankruptcy process and receive your discharge, you must also complete the second “Debtor Education” course.
From the beginning, I sit down with each client to discuss and plan their goals. During our second meeting, I’ll meet with you in person, review your intake, and prepare your petition. You will never be handed off to a paralegal—I handle your case personally. I limit myself to fewer than 20 cases a month to ensure I can give you the focused attention you deserve. I will be with you every step of the way, including in court.
Step 3
An Easy, More Accurate Intake
Your Action: To save time and improve accuracy, please fill out the form below. We will send you a link to complete your MyChapter intake. You can complete it at home, 24/7, listing your income, expenses, assets, and debts.
Next, schedule an appointment with me. I will personally prepare your petition. Once filed, the “Automatic Stay” will be activated, stopping foreclosures, garnishments, repossessions, and collections.
You’ll attend a 341 Meeting approximately 4 to 6 weeks after filing. This brief meeting will take place via Zoom from our office. The Trustee will conduct the hearing, but I’ll be right beside you. With over 35 years of experience handling these hearings, I will guide you through the entire process.
Three Federal Banking studies show that the wealthy often use the bankruptcy code to increase their wealth. The bankruptcy filing process is designed for consumers, not just businesses.
According to the Federal Reserve Bank of New York, “Individuals who file experience a sharp boost in their credit score after bankruptcy, whereas the recovery in credit score is much lower for individuals who do not file for bankruptcy.
Chapter 7 Bankruptcy: Fast, Permanent Debt Elimination
Chapter 7 bankruptcy can eliminate most unsecured debts, including credit cards, medical bills, and personal loans. It typically takes 90 to 120 days and is the quickest and most affordable way to discharge your debt.
Do You Qualify for Chapter 7?
We help you identify allowable expenses to pass the Means Test and qualify for Chapter 7. Some offices may not work to qualify you for Chapter 7, as it involves lower fees compared to Chapter 13. However, over 90% of debtors qualify for Chapter 7, especially if you have below-average income or no disposable income.
Protecting Your Assets
We maximize exemptions to help you keep your home and car. You’ll have the option to decide whether to keep or surrender your car based on your situation. Federal exemptions are larger than state exemptions, allowing you to keep more property.
Non-Consumer Debt Advantage
If more than half of your debt is business-related or incurred during military service, the Means Test is waived, making you eligible to file for Chapter 7. Other special tests may also allow you to file for Chapter 7.
Chapter 13 Bankruptcy: Protecting Your Home, Car, and Financial Stability
Chapter 13 offers a 3-5 year debt repayment plan that allows you to catch up on secured debts and manage priority obligations.
Stopping Foreclosure: Chapter 13 provides a way to resolve mortgage defaults over the plan’s duration, effectively halting any foreclosure proceedings. By the end of the Chapter 13 plan, the default is cured.
Reducing Car Loan Debt: Through a Cram Down, we can often reduce the amount owed on car loans that are over 910 days old, making payments more manageable within the Chapter 13 framework.
Stripping Liens and Second Mortgages: If you’ve been sued, Chapter 13 allows for the potential removal of judicial liens on your property. Additionally, in a Chapter 13, we can often eliminate second mortgages if the home’s value is equal to or less than the amount of the first mortgage.
Managing Hard Debts: If you’re dealing with older income tax debts, I bring experience as a former tax prosecutor and an accounting background, with a #51 license before the U.S. Tax Court. For student loans, Chapter 13 offers an opportunity to pause payments or restructure them over a 5-year period, providing much-needed relief.
Critical Defenses We Use to Protect La Grange Families
Ending Creditor Harassment and Seizures
We take immediate action to stop creditor harassment and prevent any further seizures of your property.
Recapturing Attached Bank Funds and Garnished Wages
We may be able to recover funds that were garnished in the 90 days leading up to your filing, helping you regain control of your finances.
Protecting Co-Signers
In Chapter 13 cases, we use the Co-Debtor Stay to protect co-signers. This ensures that the secured debt is paid in full throughout the duration of the Chapter 13 plan, shielding co-signers from collection actions.
Immediately Stopping Repossessions
We act quickly to get your car back or recover garnished funds. The sooner we file, the better the chance of reclaiming your assets. Don’t wait until it’s too late—acting quickly is crucial.
Stopping Foreclosure Sales Immediately
A foreclosure sale can be stopped even if it’s only moments away. If you file for bankruptcy, foreclosure proceedings can be halted instantly. Don’t wait until the last minute. It takes hours or even days to gather your documents, complete the required course, and prepare your petition. Use our intake system to get started quickly and easily from home.
