Enhance your credit score, boost your net worth, and secure your family’s future. Follow our easy 3-Step Filing Process to get started.
Step 1: Gather Your Documents
Trustees and Judges trust debtors to provide accurate information, but it’s their responsibility to verify the petition with the necessary supporting documents required for filing bankruptcy.
Your Action: To begin the bankruptcy filing process, the court requires you to gather a simple set of documents. The Judge and Trustee need these documents to verify your financial situation. Required documents include tax returns, the last six months of pay stubs, bank statements, car titles, property deeds and mortgages, Social Security cards, and your driver’s license.
Here is the Checklist for Consumers. This is the checklist for a small business bankruptcy. The Judge and Trustee need these documents to verify your petition and proceed with your case. Please save them in the correct order on a thumb drive in PDF format.
We begin the process by having you sign up for an intake, which you can complete from the comfort of your home. To get started, simply fill out the form at the bottom of this page.
Step 2 Credit Counseling
For every Chapter 7 or 13 case, you must complete a 1-2 hour online Credit Counseling course before filing, followed by a second Debtor Education course after filing to receive your discharge.
Your Action: I like https://bkcert.com/, but prebk.com and other providers are cheaper. Our attorney code for pre-bankruptcy counseling is NT 0905. While you can choose any provider, it’s essential to complete the entire chat session at the end; otherwise, the certificate won’t be issued. If the course isn’t completed and the certificate is not obtained, the court may dismiss your case. Additionally, you must complete the second “Debtor Education” course to receive your discharge.
We begin by sitting down with you to understand your goals. During a follow-up meeting, I will personally meet with you, review your intake, and prepare your petition. You will never be handed off to a paralegal. I attend court with you and am with you throughout the process. To ensure quality attention, I handle fewer than 20 cases per month.
Step 3 Online Intake
A Simple, Accurate Intake Process
Your Action:
To save time and ensure accuracy, please fill out the form below. Once submitted, we will send you a link to complete your MyChapter intake. You can complete it from the comfort of your home, 24/7, providing details about your income, expenses, assets, and debts.
Next, schedule an appointment. I will personally prepare your petition. Upon filing, the “Automatic Stay” will be activated, halting foreclosures, garnishments, repossessions, and collections.
341 Meeting:
Around 4 to 6 weeks after filing, you’ll attend a brief 341 Meeting via Zoom from our office. The Trustee will conduct the hearing, but I will be by your side, offering guidance. With over 35 years of experience, I will be there every step of the way.
Experience Matters
ABI statistics show 98%-100% of do-it-yourself Chapter 13 cases are dismissed.
Law firms nationwide complete or discharge only 40% of Chapter 13 plans.
Our KY Chapter 13 discharge or completion success ratio is over 60%.
Our success ratio for Chapter 7 discharge is over 99%.
Three Federal Banking studies show that the wealthy use the bankruptcy code to increase their wealth. The bankruptcy filing process was designed for consumer bankruptcy, not just for businesses.
“Individuals who file experience a sharp boost in their credit score after bankruptcy, whereas the recovery in credit score is much lower for individuals who do not file for bankruptcy.” — Federal Reserve Bank of New York
Chapter 7 Bankruptcy: Fast, Permanent Debt Elimination
Chapter 7 helps eliminate most unsecured debts like credit cards, medical bills, and personal loans. The process typically takes 90 to 120 days, making it the fastest and most affordable option to discharge your debt.
Do You Qualify?
We help identify allowable expenses that can help you pass the Means Test and qualify for Chapter 7. Some offices may not prioritize helping you qualify for Chapter 7 because Chapter 13 requires higher fees. However, over 90% of debtors should be eligible for Chapter 7. You may qualify if your income is below average or if you have no disposable income.
Protecting Your Assets:
We work to maximize exemptions, allowing you to keep important assets such as your home and car. You have the choice to keep or surrender your car based on your needs. Federal exemptions are often larger than state exemptions, meaning you can keep more property.
Non-Consumer Debt Benefit:
If over half of your debt is business-related or incurred during military service, the Means Test is waived. There are also other exceptions that may allow you to bypass the Means Test and file under Chapter 7. If you’ve recently become disabled, your income from the past 6 months might not be considered.
Chapter 13 Bankruptcy: Protecting Your Home, Car, and Financial Stability
Chapter 13 is a 3-5 year debt consolidation plan, allowing you to catch up on secured and priority debts without paying interest on unsecured debt or defaulted payments for the full term.
Stopping Foreclosure:
We work to cure mortgage defaults throughout the plan, ensuring that any foreclosure or default is resolved by the end of the Chapter 13 process.
Reducing Car Loan Debt:
Chapter 13 allows us to perform a Cram Down on car loans that are more than 910 days old, often making them more affordable.
Stripping Liens and Second Mortgages:
If you’ve been sued, we can strip judicial liens from your home in both Chapter 7 and Chapter 13. In a Chapter 13, we can also remove a second mortgage if there is no equity in the home, meaning the home’s value is equal to or less than the first mortgage.
Managing Hard Debts:
We also handle older income tax debts. With my background as a former tax prosecutor and accounting expertise, I’m licensed to represent you before the US Tax Court. Student loan payments can be paused or managed over 5 years under Chapter 13.
Critical Defenses We Use to Protect Taylorsville Families
Ending Creditor Harassment and Seizures
Recovering Garnished Funds and Seized Bank Accounts: We may be able to recover funds that were garnished from your wages or bank accounts in the 90 days leading up to filing.
Protecting Co-Signers:
The Co-Debtor Stay helps protect co-signers by ensuring that the debt is repaid in full under Chapter 13.
Stopping Repossessions Immediately:
We act quickly to recover your car or reverse garnishment of funds. The sooner we file, the more likely it is to stop repossession and return garnished wages.
Preventing Foreclosure Sales:
The clock is ticking! If you file even one minute after a foreclosure auction, you may lose your home. Don’t wait until the last moment. Filing involves gathering documents, taking the required class, and properly preparing and filing the petition — all of which can take hours or even days. Use our intake process to quickly and easily prepare from the comfort of your home.
Improving Credit:
Bankruptcy can be a stepping stone to a better financial future, not the end of your credit journey. Staying in default is more damaging than starting fresh and working toward rebuilding your credit to a 720 FICO score.
