We protect your home, assets, and income. Boost your credit score, increase your net worth, and care for your family. Follow these easy 3 steps to file.
Step 1
Collect Your Documents
Trustees and Judges trust debtors, but their role is to verify the petition using supporting documents, which are necessary for filing bankruptcy.
Your Action: To file for bankruptcy, the court needs you to gather a few essential documents. These documents serve as proof of your financial situation and are required by the Judge and Trustee. This includes tax returns, the last six months of pay stubs, bank statements, car titles, deeds and mortgages, Social Security cards, and your driver’s license.
Here is the Checklist for Consumers. This is the checklist for a small business bankruptcy. The Judge and Trustee cannot do their jobs without these documents to verify your petition. The documents should be saved in order on a thumb drive in PDF format. We start cases by having you sign up for an intake that you complete at home. To sign up, complete the form at the bottom of this page.
Step 2
Before filing a Chapter 7 or 13 case, you must complete a 1-2 hour online Credit Counseling session. After filing, a second Debtor Education course is required to finalize the discharge process.
Your Action: I like https://bkcert.com/, but prebk.com and other providers are cheaper. Our attorney code for pre-bankruptcy counseling is NT 0905. You must use this specific code and complete the entire chat session to ensure the certificate is issued. If you do not complete the course and obtain the certificate, the court may dismiss your case. Additionally, you must complete the second “Debtor Education” course to secure your discharge.
At the beginning, we sit down with you to set clear goals. In a second meeting, I’ll personally meet with you, review your intake, and prepare your petition. You’ll never be handed over to a paralegal. I will represent you in court and stand by your side throughout the process. I take on fewer than 20 cases per month to ensure you get the full attention you deserve.
Step 3
A Streamlined and Accurate Intake Process
Your Action: To save time and enhance accuracy, please complete the form below. After submission, we’ll send you a link to finalize your MyChapter intake. You can easily finish it at your convenience, 24/7, from home, and provide details about your income, expenses, assets, and debts.
After that, schedule a meeting. I will personally handle the preparation of your petition. Once filed, the “Automatic Stay” is triggered, stopping any foreclosures, garnishments, repossessions, and collections.
341 Meeting: Approximately 4 to 6 weeks after filing, you’ll attend a brief 341 Meeting via Zoom from our office. The Trustee will lead the meeting, but I’ll be there with you. With over 35 years of experience, I’ll ensure you’re guided through every step of the process.
Experience Matters
ABI statistics show 98%-100% of do-it-yourself Chapter 13 cases are dismissed.
Law firms nationwide complete or discharge only 40% of Chapter 13 plans.
Our KY Chapter 13 discharge or completion success ratio is over 60%.
Our success ratio for Chapter 7 discharge is over 99%.
Three studies conducted by federal banks reveal that the wealthy frequently leverage the bankruptcy code to build their wealth. The bankruptcy process is specifically intended for consumers, not just corporations.
The Federal Reserve Bank of New York states, “People who file for bankruptcy see a sharp improvement in their credit score, while those who don’t file experience a much slower recovery.
Chapter 7 Bankruptcy: Quick, Lasting Debt Relief
Chapter 7 helps eliminate most unsecured debts, including credit cards, medical bills, and personal loans. It typically takes 90 to 120 days and is the fastest, most affordable way to clear your debt.
Do You Qualify?
We assess allowable expenses to help you pass the Means Test and qualify for Chapter 7. Some offices may push for Chapter 13, which involves higher fees, but over 90% of debtors qualify for Chapter 7. You can qualify if your income is below the average or if you have no disposable income.
Protecting Your Assets
We make the most of exemptions to help you keep your home and car. Whether you keep or surrender your car depends on your specific needs. Federal exemptions are generally more generous than state exemptions, so you can protect more of your property.
Non-Consumer Debt Benefit
The Means Test is waived if more than half of your debt is business-related or incurred during military service. Other criteria may also allow you to qualify for Chapter 7. Both Chapter 7 and Chapter 13 can also protect Debtors with small businesses
Chapter 13 Bankruptcy: Protecting Home, Car, and Financial Security
Chapter 13 is a 3 to 5-year debt consolidation plan designed to help you catch up on secured debts and manage priority debts.
Stopping Foreclosure:
We resolve mortgage defaults over the course of the plan, ensuring that any foreclosure or default is fully addressed by the end of the Chapter 13 process.
Reducing Car Loan Debt:
We can often reduce car loan balances through a Cram Down on loans older than 910 days, making the payments more manageable within a Chapter 13 plan.
Stripping Liens and Second Mortgages:
If you’ve been sued, we can often remove judicial liens from your home in both Chapter 7 and Chapter 13. In Chapter 13, we can also eliminate a second mortgage if your home’s value is equal to or less than the first mortgage balance.
Managing Difficult Debts:
We assist with resolving older income tax debts. As a former tax prosecutor with accounting expertise and a license #51 before the US Tax Court, I’m equipped to help. Additionally, student loan payments can be paused or restructured over a 5-year period under Chapter 13.
Key Foreclosure Defenses to Safeguard Middletown Families
Stopping Creditor Harassment and Asset Seizures
We move swiftly to halt creditor harassment and prevent further seizures of your property, giving you the peace of mind you deserve.
Recovering Garnished Funds and Attached Bank Accounts:
If funds have been garnished within the last 90 days, we may be able to recover them, putting money back where it belongs.
Protecting Co-Signers:
Through the Co-Debtor Stay, we shield co-signers in Chapter 13 cases, ensuring that any secured debt is fully paid during the course of the repayment plan.
Acting Quickly to Stop Repossessions:
When repossession is imminent, we act fast to help get your car back or have garnished funds returned. Waiting too long—especially past a foreclosure sale—could still allow us to recover your home.
Instantly Stopping Foreclosure Sales:
Even one minute after a foreclosure sale can result in losing your home. Don’t wait until it’s too late. Gather the necessary documents, complete the required classes, and prepare your petition quickly using our easy intake process, all from the comfort of your home.
