Follow these straightforward 3-step filing process:

Step 1

Collect Your Required Documents
While trustees and judges trust debtors, their job is to verify the information presented in your bankruptcy petition through supporting documents. These documents are essential for filing.

Your Action:
In order to file for bankruptcy, you will need to compile a specific set of documents. These are required by both the judge and the trustee to confirm your financial situation. The documents include: your most recent tax returns, the past six months of pay stubs, bank statements, car titles, deeds, mortgages, Social Security cards, and a valid driver’s license.

Here is the Checklist for Consumers. This is the checklist for a small business bankruptcy. The Judge and Trustee cannot do their jobs without these documents to verify your petition. The documents should be saved in order on a thumb drive in PDF format. We start cases by having you sign up for an intake that you complete at home.  To sign up, complete the form at the bottom of this page.

Step 2

For both Chapter 7 and Chapter 13 cases, you are required to complete an online Credit Counseling course that lasts 1-2 hours before filing for bankruptcy. After filing, you must also take a second Debtor Education course to finalize the process and receive your discharge.

Your Action: I like https://bkcert.com/, but prebk.com and other providers are cheaper. Our pre-bankruptcy attorney code is NT 0905. You must use this exact code with your chosen provider to ensure proper processing. It is crucial to complete the entire chat session at the end of the course; without finishing this step, the certificate will not be issued. If the course is not completed, the court may dismiss your case. Additionally, to finalize the process and receive your discharge, you are required to complete the second “Debtor Education” course.

We begin by sitting down together to outline your goals and create a plan. In the second meeting, I will personally meet with you, review your intake details, and draft your petition. You won’t be handed off to a paralegal—I personally manage your case from start to finish. I accompany you in court and guide you through every step of the process. To maintain high-quality service, I limit my caseload to fewer than 20 cases per month, ensuring you receive the personal attention you deserve.

Step 3

A Simple and More Accurate Intake Process

Your Action:
To save time and ensure greater accuracy, please fill out the form below. We will then send you a link to complete your MyChapter intake. This can be done at your convenience, 24/7, from the comfort of your home. You’ll need to provide details about your income, expenses, assets, and debts.

Once you’ve completed the intake, schedule an appointment. I will personally prepare your petition, ensuring that it’s tailored to your specific case. When we file your petition, the Automatic Stay is activated, halting foreclosures, garnishments, repossessions, and collections.

After filing, your 341 Meeting will take place around 4 to 6 weeks later. You’ll attend this brief meeting via Zoom from our office. The Trustee will conduct the hearing, but I will be there with you. With over 35 years of experience, I’ll guide you through the process every step of the way.

Experience Matters

ABI statistics show 98%-100% of do-it-yourself Chapter 13 cases are dismissed.

Law firms nationwide complete or discharge only 40% of Chapter 13 plans.

Our KY Chapter 13 discharge or completion success ratio is over 60%.

Our success ratio for Chapter 7 discharge is over 99%.

Three federal banking studies show that the wealthy often leverage the bankruptcy code to grow their wealth.
The bankruptcy filing process is specifically designed for consumers, not just businesses.

According to the Federal Reserve Bank of New York, “Individuals who file experience a significant increase in their credit score after bankruptcy, whereas those who don’t file see a much slower recovery in their credit score.”

Chapter 7 Bankruptcy: Fast, Permanent Debt Relief

Chapter 7 bankruptcy can eliminate most types of unsecured debt, such as credit cards, medical bills, and personal loans. It typically takes 90 to 120 days and is the fastest, most affordable option for clearing your debts.

Do You Qualify for Chapter 7?

We help you identify eligible expenses to help you pass the Means Test and qualify for Chapter 7. Since Chapter 13 involves significantly higher fees, some offices may not prioritize qualifying you for Chapter 7. However, over 90% of debtors are eligible for Chapter 7, especially if your income is below the median or you have no disposable income.

Protecting Your Assets

We take full advantage of exemptions to ensure you can keep your home and car. You have the flexibility to decide whether to keep or give up your car based on your personal situation. Federal exemptions are broader than state exemptions, allowing you to retain more property.

Non-Consumer Debt Advantage

If more than half of your debt is business-related or incurred during military service, the Means Test is waived, making you eligible to file for Chapter 7. Other qualifying factors may also apply to help you file under Chapter 7.

Chapter 13 Bankruptcy: Protecting Home, Car, and Financial Stability

Chapter 13 is a debt consolidation plan lasting 3 to 5 years, designed to help you catch up on secured debts and manage priority debts.

Stopping Foreclosure

We work to resolve mortgage defaults over the course of the Chapter 13 plan, ensuring any foreclosure or default is addressed by the plan’s completion.

Reducing Car Loan Debt

We can often perform a Cram Down on car loans that are over 910 days old, reducing the loan balance and making payments more manageable within a Chapter 13.

Stripping Liens and Second Mortgages

If you’ve been sued, we may be able to strip judicial liens from your home in both Chapter 7 and Chapter 13. In Chapter 13, we can also eliminate a second mortgage if the home’s value is equal to or less than the first mortgage, helping you retain more of your property.

Managing Difficult Debts

We also assist with older income tax debts. With my experience as a former tax prosecutor and a background in accounting, I am well-equipped to help manage your tax-related issues. Additionally, in Chapter 13, student loan payments can be paused or restructured over a 5-year repayment period.

Stopping Creditor Harassment and Seizures

We act quickly to stop creditor harassment and prevent further seizures of your property.

Recovering Garnished Funds and Attached Bank Accounts

We may be able to recover funds that were garnished in the 90 days prior to filing for bankruptcy, helping you regain control over your finances.

Protecting Co-Signers

Through the Co-Debtor Stay, we protect co-signers in Chapter 13 cases. This ensures that any secured debt is paid in full over the course of the repayment plan.

Preventing Repossessions Immediately

We file quickly to help recover your car or return garnished wages. The sooner we act, the better the chance of recovering assets, especially if you’ve already missed a foreclosure sale.

Stopping Foreclosure Sales Instantly

The moment you file, foreclosure sales are halted. Filing even one minute after an auction can result in losing your home. Don’t wait until the last minute—gather your documents, complete the required classes, and prepare your petition promptly with our easy intake process.
