Simply follow our easy 3-Step Filing Process.
Step 1
Collect Your Documents
Trustees and Judges trust debtors, but they are required to verify the petition with the supporting documents necessary for filing bankruptcy.
Your Action: To move forward with your bankruptcy filing, the court needs you to gather a straightforward set of documents. The Judge and Trustee will use these documents to confirm your financial situation. Required documents include tax returns, the last six months of pay stubs, bank statements, car titles, deeds, mortgages, Social Security cards, and your driver’s license.
Here is the Checklist for Consumers. This is the checklist for a small business bankruptcy. The Judge and Trustee cannot proceed without these documents to verify your petition. It’s important to save them in order on a thumb drive in PDF format. We begin by having you sign up for an intake, which you can complete from home. To get started, simply fill out the form at the bottom of this page.
Step 2
For every Chapter 7 or 13 case, you must complete a 1-2 hour online Credit Counseling session before filing. After filing, a second Debtor Education course is required to receive your discharge.
Your Action: I like https://bkcert.com/, but prebk.com and other providers are cheaper. Our pre-bankruptcy attorney code is NT 0905. You must use this exact code and complete the entire chat session, or the certificate will not be issued. If this course is not completed and the certificate is not obtained, the court will dismiss your case. You must also complete the second “Debtor Education” course in order to receive your discharge.
We start by meeting with you to discuss and plan your goals. During the second meeting, I will personally meet with you, go over your intake, and prepare your petition. You will never be handed off to a paralegal for petition preparation. I’ll be by your side at court and with you through every step of the process. I take fewer than 20 cases per month, allowing me to give you the attention you deserve.
Step 3
A Simple, Accurate Intake Process
Your Action: To save time and ensure accuracy, complete the form below. Once submitted, we’ll send you a link to finish your MyChapter intake. You can complete it at home, 24/7, providing details about your income, expenses, assets, and debts.
After completing the intake, schedule an appointment. I will personally prepare your petition. Once filed, the “Automatic Stay” will be activated, halting foreclosures, garnishments, repossessions, and collections.
341 Meeting: About 4 to 6 weeks after filing, you will attend a brief 341 Meeting via Zoom from our office. The Trustee will lead the hearing, but I’ll be right there with you. With over 35 years of experience, I will guide you through the entire process.
Experience Matters
ABI statistics show 98%-100% of do-it-yourself Chapter 13 cases are dismissed.
Law firms nationwide complete or discharge only 40% of Chapter 13 plans.
Our KY Chapter 13 discharge or completion success ratio is over 60%.
Our success ratio for Chapter 7 discharge is over 99%.
Three studies conducted by federal banking institutions reveal that the wealthy often leverage the bankruptcy code to enhance their financial position. The bankruptcy process is primarily designed for consumers, not solely for businesses.
As noted by the Federal Reserve Bank of New York, “Individuals who file for bankruptcy experience a sharp rise in their credit score, whereas those who don’t file see a much slower recovery in their credit score.
Chapter 7 Bankruptcy: Fast and Permanent Debt Relief
Chapter 7 allows you to eliminate most unsecured debts, such as credit card balances, medical bills, and personal loans. The process typically takes between 90 to 120 days and is the quickest and least expensive way to get rid of your debt.
Do You Qualify?
We help identify allowable expenses that can assist you in passing the Means Test to qualify for Chapter 7. Because Chapter 13 involves higher fees, some firms may not prioritize getting you approved for Chapter 7. However, more than 90% of debtors qualify for Chapter 7, especially if you have a below-average income or no disposable income.
Protecting Your Property
We utilize exemptions to protect your home and car. You get to decide whether to keep or give up your car based on your personal needs. Federal exemptions tend to be more generous than state exemptions, helping you keep more of your property.
Non-Consumer Debt Advantage
The Means Test is waived if more than half of your debt is business-related or incurred during military service. Additional criteria may also make you eligible to file under Chapter 7.
Chapter 13 Bankruptcy: Protecting Home, Car, and Financial Security
Chapter 13 is a 3 to 5-year repayment plan that helps you consolidate your debts and catch up on missed secured payments while managing priority debts.
Stopping Foreclosure:
We work to resolve mortgage defaults throughout the plan’s duration, ensuring that by the end of the Chapter 13 process, any foreclosure or missed payments are completely cured.
Reducing Car Loan Debt:
For car loans older than 910 days, we can apply a Cram Down, reducing the loan balance and making it more affordable within the Chapter 13 plan.
Eliminating Liens and Second Mortgages:
If you’ve been sued and have a judicial lien, we can often remove it in both Chapter 7 and Chapter 13. In Chapter 13, we can also eliminate a second mortgage if your home’s value is equal to or less than the first mortgage, helping you save more of your property.
Managing Difficult Debts:
With my experience as a former tax prosecutor and accounting background, I am equipped to help with older income tax debts. Additionally, Chapter 13 allows for the suspension of student loan payments, which can also be managed over a 5-year repayment period.
