Simply follow our easy 3-Step Filing Process.

Step 1

Collect Your Documents
While Trustees and Judges trust debtors, their role is to verify the petition using the necessary supporting documents required for the bankruptcy filing.

Your Action: To proceed with your bankruptcy filing, the court needs you to gather a simple set of documents. These include proof of your finances, which the Judge and Trustee will review. Required documents include tax returns, the last six months of pay stubs, bank statements, car titles, deeds, mortgages, Social Security cards, and your driver’s license..

Here is the Checklist for Consumers. This is the checklist for a small business bankruptcy. The Judge and Trustee cannot do their jobs without these documents to verify your petition. The documents should be saved in order on a thumb drive in PDF format. We start cases by having you sign up for an intake that you complete at home.  To sign up, complete the form at the bottom of this page.

Step 2

For every Chapter 7 or 13 case, you must complete a 1-2 hour online Credit Counseling session before filing. After filing, you’ll also need to take a second Debtor Education course to receive your discharge.

Your Action: I like https://bkcert.com/, but prebk.com and other providers are cheaper. Our pre-bankruptcy attorney code is NT 0905. You must use this specific code and complete the entire chat session to ensure the certificate is issued. If the course is not completed and the certificate is not obtained, the court may dismiss your case. Additionally, you will need to complete the second “Debtor Education” course to receive your discharge.

We begin by meeting with clients to set clear goals. During a follow-up meeting, I will meet with you in person, review your intake, and prepare your petition. You will never be passed off to a paralegal. I will personally accompany you to court and guide you through every step of the process. I limit my caseload to fewer than 20 cases per month to ensure you get the personalized attention you deserve.

Step 3

A Simple, More Accurate Intake

Your Action: To save time and ensure accuracy, please fill out the form below. Afterward, we’ll send you a link to complete your MyChapter intake. You can fill out the intake at your convenience, 24/7, from home, providing details about your income, expenses, assets, and debts.

Once completed, schedule an appointment. I will personally prepare your petition. Once filed, the “Automatic Stay” is triggered, halting foreclosures, garnishments, repossessions, and collections.

341 Meeting: About 4 to 6 weeks after filing, you will attend a brief 341 Meeting via Zoom from our office. The Trustee will conduct the hearing, but I will be there with you. With over 35 years of experience, I’ll guide you through every step.

Experience Matters

ABI statistics show 98%-100% of do-it-yourself Chapter 13 cases are dismissed.

Law firms nationwide complete or discharge only 40% of Chapter 13 plans.

Our KY Chapter 13 discharge or completion success ratio is over 60%.

Our success ratio for Chapter 7 discharge is over 99%.

Three studies by federal banking institutions highlight that the wealthy frequently utilize the bankruptcy code to enhance their financial standing. The bankruptcy process was created primarily for consumers, not just for businesses.

As stated by the Federal Reserve Bank of New York, “Those who file for bankruptcy typically experience a rapid increase in their credit score, whereas individuals who do not file see a much slower recovery.

Chapter 7 Bankruptcy: Swift, Lasting Debt Relief

Chapter 7 allows you to eliminate most unsecured debts, such as credit cards, medical bills, and personal loans. The process typically takes between 90 to 120 days, making it the fastest and most affordable way to discharge your debt.

Am I Eligible?
We’ll assess your allowable expenses to help you pass the Means Test and qualify for Chapter 7. Since Chapter 13 involves higher fees, some offices may not prioritize getting you qualified for Chapter 7. However, more than 90% of debtors qualify for Chapter 7, especially if your income is below average or if you have little to no disposable income.

Safeguarding Your Assets
We maximize available exemptions to help you keep your home and car. You decide whether to keep or let go of your car, depending on your situation. Federal exemptions often offer more protection than state exemptions, allowing you to retain more of your assets.

Non-Consumer Debt Advantage
If more than half of your debt comes from business-related expenses or was incurred during military service, the Means Test is waived, enabling you to qualify for Chapter 7. Additional criteria may also allow you to file under Chapter 7.

Chapter 13 Bankruptcy: Safeguarding Home, Car, and Financial Security

Chapter 13 offers a 3-5 year debt consolidation plan that helps you catch up on overdue secured debts and prioritize essential payments.

Preventing Foreclosure:
We work to resolve mortgage defaults over the duration of the plan, ensuring that any foreclosure or missed payments are corrected by the time the Chapter 13 plan concludes.

Reducing Car Loan Debt:
For car loans older than 910 days, we can often apply a Cram Down, reducing the loan balance and making it more affordable within the Chapter 13 plan.

Eliminating Liens and Second Mortgages:
If you’ve been sued, we can often eliminate judicial liens from your property in both Chapter 7 and Chapter 13. In Chapter 13, we can also remove a second mortgage if the home’s value is equal to or lower than the balance of the first mortgage, offering greater financial relief.

Managing Challenging Debts:
With my experience as a former tax prosecutor and background in accounting, I specialize in handling complex income tax debts. Under Chapter 13, we can also manage or halt student loan payments for up to 5 years.

Key Foreclosure Defenses We Use to Safeguard Saint Matthews Families

Stopping Creditor Harassment and Asset Seizures
We take swift action to stop creditor harassment and prevent further seizures of your assets, providing you with immediate relief.

Recovering Garnished Funds and Attached Bank Accounts:
We may be able to recover funds garnished within the 90 days prior to filing, giving you back money that was wrongfully taken.

Protecting Co-Signers:
Through the Co-Debtor Stay, we protect co-signers in Chapter 13 cases, ensuring that any secured debt is fully repaid during the repayment period.

Quickly Halting Repossessions:
We file promptly to help recover your car or return garnished funds. Waiting too long—especially after a foreclosure sale—could still allow us to recover your home.
